This Privacy Policy explains how Bout It LLC ("Bout It", "we", "us", or "our") collects, uses, and discloses personal information when you visit boutitmerch.com, buy merchandise from us, sign up your business or organization to work with us, or otherwise communicate with us (together, the "Services"). Bout It LLC is an Oregon limited liability company.

Bout It runs online merchandise stores for breweries, taprooms, schools, youth sports teams, camps, clubs, and gyms. We design the merchandise, operate the storefront, take the orders, and handle fulfillment and customer service. This policy covers two groups of people: shoppers who buy merchandise from a store on boutitmerch.com, and the owners, operators, and staff of the businesses and organizations whose stores we run.

Please read this policy carefully. By using the Services, you agree to the collection, use, and disclosure of your information as described here.

Changes to This Privacy Policy

We may update this policy to reflect changes in how we work, or for legal or operational reasons. When we do, we will post the revised policy on this page, change the effective date at the top, and take any other steps the law requires.

What Personal Information We Collect

Information you give us directly

  • Contact details, including your name, email address, phone number, and mailing address.
  • Order information, including your shipping address, billing address, the items you bought, and confirmation that your payment went through. We do not store your full card number.
  • Account information, including your email address and password, if you create an account.
  • Business information, if you apply to have us run a merchandise program. This includes your business or organization name, your role, your business email and phone number, your business type, and how you heard about us.
  • Brand assets you send us, such as logos, artwork, and photographs, so we can design your merchandise and build your store.
  • Anything you write to us, including emails, support messages, and form responses.

Some parts of the Services need this information to work. You can choose not to give it to us, but then we may not be able to sell you merchandise or set up your store.

Information we collect automatically

When you use the Services we collect information about how you got here and what you do once you arrive. This includes your IP address, your device and browser type, the pages you view, the products you look at, what you put in your cart, the links you click, and the site or advertisement that referred you. We collect this using cookies, pixels, and similar technologies, described below.

Information we get from other companies

  • Shopify, which hosts our store and processes checkout, gives us your order and account details.
  • Our payment processors confirm your payment and give us your billing address and the last four digits of your card. They receive your full payment details directly, not through us.
  • Advertising and analytics companies, including Google and Meta, tell us how our advertisements perform and how people found our stores.

We are not responsible for the accuracy of information other companies give us, or for their own privacy practices.

How We Use Your Personal Information

  • To sell and deliver merchandise. We use your information to take your order, charge your payment method, send your order to our print and fulfillment partner, ship your items, send you order and shipping notifications, and handle returns and replacements.
  • To run your merchandise program, if you signed your business or organization up with us. This includes building and operating your store, designing merchandise with your brand assets, creating marketing materials, reporting your sales back to you, and paying you your share.
  • To provide customer service. We use your information to answer your questions and fix problems with your order.
  • To market our merchandise and our program. We send emails and show advertisements about products and about working with Bout It. You can unsubscribe from marketing emails at any time using the link in the email.
  • To improve the Services. We look at how people use our stores so we can make them work better.
  • To prevent fraud and keep the Services secure. We use your information to investigate suspicious, fraudulent, or illegal activity.
  • To meet our legal obligations and to enforce our Terms of Service.

Cookies and Similar Technologies

We use cookies, pixels, and similar technologies to keep the Services working, remember what is in your cart, understand how people use our stores, and measure and target our advertising. For details on the cookies Shopify sets to power our store, see shopify.com/legal/cookies.

Most browsers accept cookies automatically, and you can change your browser settings to block or delete them. Blocking cookies may stop parts of our stores from working properly, including your cart and checkout.

How We Disclose Your Personal Information

We disclose personal information to the following kinds of recipients:

  • Companies that run parts of the Services for us. Shopify hosts our store and handles checkout. Printful prints and ships our merchandise, which means they receive your name and shipping address. Our payment processors handle payments. Sami Wholesale runs the sign-up form for businesses and organizations applying to work with us. We also use Google Workspace for email and file storage, HubSpot to manage business and client records, and Slack for internal notifications.
  • Advertising and analytics companies, including Google and Meta, as described in the next section.
  • The business or organization whose store you bought from. We report sales results to them. These reports cover what sold and how much revenue it generated. They do not include your name, your address, or your contact details.
  • Anyone you ask us to share with, or where you have given consent.
  • Legal and business recipients. We may disclose information to comply with the law, respond to lawful requests such as subpoenas, enforce our Terms of Service, protect our rights or the rights of others, or in connection with a sale, merger, or transfer of our business.

In the past 12 months we have disclosed the following categories of personal information for the purposes described above:

We do not collect or use sensitive personal information to infer characteristics about you, and we do not sell personal information for money.

Advertising, and "Selling" and "Sharing" Your Information

We advertise our stores and our merchandise program on Google and Meta. To measure whether those advertisements work and to show relevant advertisements to people who have visited our stores, we use Google Analytics, Google Ads, and the Meta pixel. These tools send information about your visit, including your device identifiers and the pages and products you viewed, to Google and Meta.

Several state privacy laws treat this as "selling" or "sharing" personal information, or as processing personal information for targeted advertising, even though we receive no money for it. We want to be straightforward that this activity happens. Over the past 12 months we have "shared" the following for advertising purposes:

You have the right to opt out. To opt out, email us at privacy@boutitmerch.com and we will stop sharing your information for advertising purposes. If you visit our stores with the Global Privacy Control signal turned on in your browser, we treat that as an opt-out request for that browser and device.

We do not knowingly sell or share the personal information of anyone under 16 years of age. See the Children's Information section below.

Children's Information

Bout It designs and runs merchandise stores for schools, youth sports teams, camps, and clubs, so many of the people shopping with us are students and players. We want to be clear about how that works.

You need to be at least 13 to buy from us or create an account. Students buying their own school or team gear are exactly who many of these stores are for. If you are under 18, you need a parent or guardian’s permission to use the payment method, and they take responsibility for the order.

We do not knowingly collect personal information from anyone under 13, and our stores are not directed to children under 13. We never ask for age, birthday, grade, school, team, or photograph at any point in browsing, ordering, or checking out. We collect what the order needs, which is a name, an address, and a size. We collect nothing about the person who will wear the item.

Because we never ask anyone’s age, we cannot tell how old a shopper is. We do not knowingly sell or share the personal information of anyone under 16 for targeted advertising, and we do not target advertising to children. If you tell us a shopper is under 16, we will stop sharing their information for advertising and confirm to you when it is done.

If you are a parent or guardian and believe your child gave us personal information, email us at privacy@boutitmerch.com. Tell us enough to find the record, such as the email address or order number involved. We will delete the information within 30 days and confirm to you when it is done. You do not need an account and there is no charge.

If we learn that we have collected personal information from a child under 13 without a parent's consent, we delete it. We do not condition a child's participation in anything on giving us more information than we need.

If a school, team, camp, or club asks us to run a store, we work with the adult staff and administrators of that organization. We do not ask them for student or player rosters, and we do not accept personal information about students or players. If an organization sends us information about children anyway, we delete it and tell them we cannot keep it.

Reviews and Anything You Post Publicly

Parts of the Services may let you post product reviews or other content. Anything you post in a public area is public, and anyone can see it. We cannot control what people do with information you choose to make public, so please think about what you include.

Links to Other Websites

Our stores link to websites we do not run, including the websites and social media accounts of the businesses and organizations whose stores we operate. We are not responsible for their privacy practices, their security, or what they publish. Read their policies before giving them your information. A link from us is not an endorsement.

How We Protect and Keep Your Information

We take reasonable steps to protect your personal information, but no security measures are perfect, and information you send over the internet may not be secure in transit. Please do not send us sensitive or confidential information through channels that are not secure.

We keep your personal information for as long as we need it to provide the Services, maintain your account, meet our legal and tax obligations, resolve disputes, and enforce our agreements. When we no longer need it, we delete it or make it anonymous.

Your Rights and Choices

Depending on where you live, you may have some or all of the rights below. These rights are not absolute, and in some cases we may decline a request where the law allows.

  • Access. Ask us what personal information we hold about you and how we use and share it.
  • Deletion. Ask us to delete the personal information we hold about you.
  • Correction. Ask us to fix personal information that is wrong.
  • Portability. Ask for a copy of your personal information, or ask us to send it to another company.
  • Opt out of sale, sharing, or targeted advertising. Tell us to stop sharing your personal information for advertising, as described above.
  • Restrict processing. Ask us to stop or limit how we use your personal information.
  • Withdraw consent. Where we rely on your consent, you can take it back at any time.
  • Appeal. If we turn down your request, you can appeal by replying to our response.
  • Manage marketing emails. Unsubscribe using the link at the bottom of any marketing email. We will still send you messages about your orders and your account.

To exercise any of these rights, email us at privacy@boutitmerch.com. We may need to confirm who you are before we act, usually by matching the email address or order details you give us against our records. You can name someone to make a request for you, and we will ask for proof that you authorized them. We will respond within the time the law requires. We will not treat you differently for exercising any of these rights.

Complaints

If you have a complaint about how we handle your personal information, email us at privacy@boutitmerch.com. If our answer does not resolve it, you may be able to appeal with us or file a complaint with your local data protection authority, depending on where you live.

If You Are Outside the United States

Bout It operates in the United States, and we store and process personal information here. If you use the Services from another country, your information will be transferred to the United States, where privacy laws may differ from those in your country. If we transfer personal information out of the European Economic Area or the United Kingdom, we rely on recognized transfer mechanisms such as the European Commission's Standard Contractual Clauses, unless the destination country has been found to provide adequate protection. For the purposes of data protection law, Bout It LLC is the controller of your personal information.
