Terms of service

These Terms of Service govern your use of boutitmerch.com and anything you buy from us. The site is operated by Bout It LLC, an Oregon limited liability company ("Bout It", "we", "us", or "our").

By visiting our site or buying something from us, you agree to these terms, along with our Privacy Policy, Returns and Exchanges Policy, and Shipping Policy. If you do not agree, please do not use the site.

These terms apply to everyone who uses the site, including shoppers, businesses and organizations whose stores we run, and vendors.

We may update these terms. When we do, we will post the new version on this page and change the effective date. Continuing to use the site after we post a change means you accept it. Our store runs on Shopify, which provides the e-commerce software that lets us sell to you.

1. Who Can Use the Site

You must be at least 13 years old to buy from us or create an account. Many of our stores serve schools, teams, camps, and clubs, and students buying their own gear are welcome here. If you are under 18, you need a parent or guardian’s permission to use the payment method, and they take responsibility for the order.

Our site is not intended for children under 13, and we do not knowingly collect their information. See our Privacy Policy for details.

You may not use our products for any unlawful purpose, break any law that applies to you, or send us any virus or malicious code. If you break these terms, we may end your access to the site immediately.

2. Our Products

Everything we sell is made to order. We print or embroider each item after you buy it, which is why we do not carry inventory and why our returns policy works the way it does.

We show product colors and images as accurately as we can, but screens vary, and the item you receive may look slightly different from what you saw. Printed and embroidered items also have small variations from piece to piece, which is normal for this kind of production and is not a defect.

Prices can change without notice. We may limit quantities, restrict sales to particular people or places, and discontinue any product at any time. Any offer we make is void where prohibited.

3. Orders, Payment, and Accuracy

You agree to give us current, complete, and accurate purchase and account information, and to keep it up to date so we can complete your order and reach you if we need to.

We may refuse or cancel any order. We may limit or cancel quantities bought per person, per household, or per order, including orders placed on the same account, with the same card, or to the same address. We may also limit or refuse orders that look like they come from dealers or resellers. If we change or cancel your order, we will try to reach you at the email address or phone number you gave us.

Because our items are made to order, we send your order into production shortly after you place it, and we usually cannot change or cancel it after that. If you need to change an order, email orders@boutitmerch.com right away and we will do what we can.

4. Shipping, Returns, and Replacements

Our Shipping Policy explains how long orders take and what shipping costs. Our Returns and Exchanges Policy explains what happens if an item arrives damaged, misprinted, or wrong, and what we offer if you need a different size. Both are part of these terms.

5. Brands and Artwork on Our Merchandise

The merchandise we sell carries the brands, logos, and marks of the businesses and organizations whose stores we run. Those marks belong to them, not to you and not to us, and buying an item does not give you any right to use them. You may not reproduce, copy, or resell our designs or artwork without written permission.

If you sign your business or organization up with us, you keep ownership of your own brand assets. You give us permission to use your logo, artwork, colors, and name to design your merchandise, build and run your store, and market it. That permission lasts while we run your program and ends when the program ends, except for materials already printed or published. You confirm that you have the right to give us those assets and that they do not infringe anyone else's rights.

6. Your Account

If you create an account, you are responsible for keeping your password safe and for what happens under your account. Do not share your login. If you think someone else has your credentials, contact us immediately.

7. Reviews, Comments, and Anything You Send Us

If you send us ideas, suggestions, designs, reviews, or other material, whether we asked for it or not, you agree we may use, edit, publish, and distribute it without paying you, keeping it confidential, or responding to it.

You agree that anything you send will not violate anyone's rights, and will not be unlawful, abusive, obscene, defamatory, or contain malicious code. You may not use a false email address or pretend to be someone else. You are responsible for what you post. We may remove content we consider objectionable, but we are not obligated to monitor it.

8. Prohibited Uses

You may not use the site or its content for any unlawful purpose, to encourage anyone else to break the law, to violate anyone's intellectual property rights, to harass or discriminate against anyone, to submit false information, to upload viruses or malicious code, to collect other people's personal information, to send spam, to scrape or crawl the site, or to interfere with the site's security. We may end your access for any of these.

9. Third-Party Tools and Links

Our site uses third-party tools and links to websites we do not control, including the websites and social media accounts of the businesses whose stores we run. We provide access to these as is, without any warranty, and we are not responsible for them. Read their terms and policies before you use them. Complaints about a third party should go to that third party.

10. Your Personal Information

Our Privacy Policy explains what we collect, how we use it, and who we share it with.

11. Errors and Omissions

Our site may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, shipping charges, transit times, or availability. We may correct any of these and change or cancel orders if the information was wrong, including after you placed your order. We are not obligated to update information on the site except where the law requires it.

12. Disclaimer of Warranties and Limitation of Liability

We do not guarantee that your use of the site will be uninterrupted, secure, or error-free, or that the results you get from it will be accurate or reliable. We may remove or cancel the site at any time without notice.

You use the site at your own risk. Except where we have said otherwise, the site and everything we deliver through it are provided as is and as available, without warranties or conditions of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

To the fullest extent the law allows, Bout It LLC and its members, employees, agents, contractors, suppliers, and service providers are not liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, lost data, or replacement costs, arising from your use of the site or any product you buy from us, even if we were told they were possible. Some states do not allow these exclusions, and in those states our liability is limited to the maximum extent the law allows.

13. Indemnification

You agree to defend and hold harmless Bout It LLC and its members, employees, agents, contractors, and suppliers from any claim or demand, including reasonable attorneys' fees, made by a third party because you broke these terms or any law, or violated someone else's rights.

14. Severability

If any part of these terms is found to be unlawful or unenforceable, that part will be enforced to the fullest extent the law allows, and the rest of the terms stay in effect.

15. Termination

These terms stay in effect until you or we end them. You can end them by telling us you no longer wish to use our services, or by stopping. If we believe you have broken these terms, we may end them at any time without notice, and you will still owe us any amounts due up to that date. Obligations and liabilities from before termination survive it.

16. Entire Agreement

These terms, together with the policies posted on our site, are the entire agreement between you and us about your use of the site, and they replace any earlier agreements between us. If we do not enforce a right or provision, that does not waive it. Any ambiguity in these terms will not be interpreted against us simply because we wrote them.

17. Governing Law

These terms are governed by the laws of the State of Oregon, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Deschutes County, Oregon, and you agree those courts have jurisdiction over you.
